No, it's a bug. i added to the tracker:

A question: what change was done to the list's visibility?
Can you check the list config to know if the topics really disappeared 
or are just hidden?

Maybe. what do you mean with "control the topics selection"? If it means 
"hide some topics to all subscribers and let them visible to owners" it 
is possible : just modify the template to show topics based on a 
condition using one or several custom_parameters :

Is it's a "per user" selection, then your suggestion of using sub lists 
is probably the best one.
