Does anyone know a fix?  Or is this a bug?

Probably not a bug.
I just re-tested it on the server hosting the sympa-users mailing list (which is a 6.1.23) and merge on both header and footer work.
Would it be possible that the merge_feature on this list would be set to "off"?
Also, is your message is S/MIME signed, merge won't be used, as it wouls break the signature.

But maybe I diud'nt understand you problem. What do you mean by "escaped to ASCII"?
