As I see it, the issue is that every list has a mix of people reading in 
text mode, with others reading in HTML mode.  Headers and Footers should 
really just work for everyone - with the list manager 
inserting/appending stuff as appropriate.  These days, email can be sent 
as text, HTML, or both - and read by people who can read text only, 
HTML, or both - and headers/footers should just show up properly for all 
combinations of message type and email reader settings.  Easier said 
than done, though.
